We explicate and evaluate arguments both for and against the insanity defense itself, different versions of the insanity defense (M'Naghten, Model Penal Code, and Durham (or Product)), the Irresistible Impulse rule, and various reform proposals.

Many years after the publication of “A Logical Calculus of the Ideas Immanent in Nervous Activity,” Warren McCulloch gave Walter Pitts credit for contributing his knowledge of modular mathematics to their joint project. In 1941 I presented my notions on the flow of information through ranks of neurons to Rashevsky’s seminar in the Committee on Mathematical Biology of the University of Chicago and met Walter Pitts, who then was about seventeen years old. He was working on a mathematical (...) theory of learning and I was much impressed. He was interested in problems of circularity, how to handle regenerative nervous activity in closed loops....For two years Walter and I worked on these problems whose solution depended upon modular mathematics of which I knew nothing, but Walter did.. In this paper, we will fill in some of the details regarding Pitts’s interest in problems of circularity, regenerative activity in closed loops of neurons, and modular mathematics, and the way in which they relate to “A Logical Calculus.”. Throughout the history of philosophy, skepticism has posed one of the central challenges of epistemology. Opponents of skepticism--including externalists, contextualists, foundationalists, and coherentists--have focussed largely on one particular variety of skepticism, often called Cartesian or Academic skepticism, which makes the radical claim that nobody can know anything. However, this version of skepticism is something of a straw man, since virtually no philosopher endorses this radical skeptical claim. The only skeptical view that has been truly held--by Sextus, Montaigne, Hume, Wittgenstein, and, (...) most recently, Robert Fogelin--has been Pyrrohnian skepticism. Pyrrhonian skeptics do not assert Cartesian skepticism, but neither do they deny it. The Pyrrhonian skeptics' doubts run so deep that they suspend belief even about Cartesian skepticism and its denial. Nonetheless, some Pyrrhonians argue that they can still hold "common beliefs of everyday life" and can even claim to know some truths in an everyday way. This edited volume presents previously unpublished articles on this subject by a strikingly impressive group of philosophers, who engage with both historical and contemporary versions of Pyrrhonian skepticism. Among them are Gisela Striker, Janet Broughton, Don Garrett, Ken Winkler, Hans Sluga, Ernest Sosa, Michael Williams, Barry Stroud, Robert Fogelin, and Roy Sorensen. Although a very recent topic in contemporary logic, the subject of combinations of logics has already shown its deep possibilities. Besides the pure philosophical interest offered by the possibility of defining mixed logic systems in which distinct operators obey logics of different nature, there are also several pragmatical and methodological reasons for considering combined logics. We survey methods for combining logics (integration of several logic systems into a homogeneous environment) as well as methods for decomposing logics, showing their interesting properties (...) and applications. This book is an interdisciplinary exploration of the notion of childhood and its place in philosophical education. Childhood is not seen as a developmental state that needs to be overcome, but rather an existential state that constitutes a significant part of being human as well as the (forgotten) dimension of the world itself.

The continuing discovery of important Hegel manuscripts and advances in the criticism of Hegel's works have set the stage for a major reevaluation of one of the greatest philosophers of all time. However, recent scientific developments in genetic engineering, namely CRISPR/Cas bring the question into public discourse, how the genetic enhancement of humans should be evaluated morally.

In this paper the author seeks to clearly define the distinctions between religion and theology in the interest of furthering the discussion on religion. The author defines the two phrases, as well as the term empathy and how the former two relate to the latter. The author uses both ancient and modern references to establish the nature of empathy, and discuss how religion and theology have been confused in the past. Lastly, the author discusses the future of theology in civilization.

Frege seems committed to the thesis that the senses of the fundamental notions of arithmetic remain stable and are stably grasped by thinkers throughout history. Fully competent practitioners grasp those senses clearly and distinctly, while uncertain practitioners see them, the very same senses, “as if through a mist”. There is thus a common object of the understanding apprehended to a greater or lesser degree by thinkers of diverging conceptual competence. Frege takes the thesis to be a condition for the possibility (...) of the rational intelligibility of mathematical practice. I argue however that the idea that senses could be grasped as a matter of degree is in tension with the constitutive theses that Frege held with regard to sense. Given those theses, there can in fact be no such thing as misty grasp of sense, since any uncertainty as to the logical features of a given sense will entail that one is getting hold of a different sense or of no sense at all. I consider various ways of resolving the tension and conclude that Frege’s thesis cannot be defended if we take it to be a thesis about our competence with concepts. This leaves unresolved what I call the problem of normative guidance, that is, the problem of explaining how the fundamental notions of logic and arithmetic can provide inferential guidance to thinkers. Study of electroencephalographic brain activity in behaving animals has guided development of a model for the self-organization of goal-directed behavior. Synthesis of a dynamical representation of brain function is based in the concept of intentionality as the organizing principle of animal and human behavior. The constructions of patterns of brain activity constitute meaning and not information or representations. The three accepted meanings of intention: "aboutness," goal-seeking, and wound healing, can be incorporated into the dynamics of meaningful behavior, centered in the (...) limbic system interacting with the sensory and motor systems. Evidence is noted for the maintenance in cortical neuropil of a felt work of synaptic connections, that have incorporated past experience by changes in learning, and that act as a unified whole in shaping each intentional action at each moment. This constitutes the intentional structure of the brain. Meaning is a focus having a place without edges in this structure. The focus continually moves through it along a chaotic trajectory; the meaning occupies the whole structure. In this view, consciousness is the active state of an intentional structure, and awareness is the subjective aspect of the shifting focus. (shrink)

Polynomizing is a term that intends to describe the uses of polynomial-like representations as a reasoning strategy and as a tool for scientific heuristics. I show how proof-theory and semantics for classical and several non-classical logics can be approached from this perspective, and discuss the assessment of this prospect, in particular to recover certain ideas of George Boole in unifying logic, algebra and the differential calculus.

Argument for the role of the human conscience in determining right and wrong, good and evil.

It has been claimed by Diana Raffman, that atonal (and in particular serial) music can have no aesthetic value, because it is in an important sense meaningless. This worthlessness is claimed to result from cognitive/psychological facts about human listeners that have been confirmed by empirical investigations such as those conducted by Lerdahl and Jackendoff. Similar assertions about the necessary inferiority of 12-tone music have been made by, among others, Taruskin, Cavell, and Goldman, some of whom echo Raffman’s suggestion that both (...) composers and performers of atonal music are committing a kind of fraud. This paper responds to all of those allegations. In particular, it points out that even if the empirical claim about human cognitive capacities with respect to the discernment of “local structure” in atonal works is assumed to be correct (which is actually quite doubtful), all the arguments brought by the “prosecution” against atonal music that rely on this claim are invalid. It is noted that such arguments by tonality advocates somewhat ironically rely on their own variety of what Taruskin has called “the poietic fallacy,” a gaff which he has frequently accused serialists (and perhaps alea supporters) of committing. Readers are reminded that the main basis for claims of aesthetic worth (or worthlessness) can never be primarily theoretical, but must be principally based on the experiences of beholders. (shrink)

Der Kardinal Nikolaus von Kues bzw. Nicolaus Cusanus (1401 - 1464) war der bedeutendste Philosoph des 15. Jahrhunderts und zugleich einer der einflussreichsten Kirchenpolitiker seiner Zeit. Neben seiner rastlosen Tätigkeit als Advokat von Fürsten und Päpsten, als Fürstbischof von Brixen und Kurienkardinal verfasste er philosophisch-theologische Schriften von historischem Rang. Ihn interessierten die großen Köpfe der europäischen Geistesgeschichte und die Intellektuellen seiner Zeit genauso wie die Alltagsprobleme der Gläubigen seines Tiroler Bistums. Besondere Beachtung verdient zudem die Tatsache, dass er einen Großteil (...) seiner Schriften in Dialogform verfasste. Die 14 Beiträge dieses Bandes zeigen in exemplarischer Weise, dass Nikolaus von Kues sowohl ein Denker im Dialog als auch ein dialogischer Denker war. (shrink)

THE FREEHOF INSTITUTE OF PROGRESSIVE HALAKHAH The Freehof Institute of Progressive Halakhah is a creative research center devoted to studying and defining the progressive character of the halakhah in accordance with the principles and theology of Reform Judaism. The Institute fosters serious studies, and helps scholars in various portions of the world to work together for a common cause. The foremost halakhic scholars in the Reform, Liberal, and Progressive rabbinate along with some Conservative and Orthodox colleagues as well as university professors serve on our Academic Council. This collection of essays is the product of the symposia held in Atlanta and Pittsburgh in 1995 and 1996. This book follows the volumes DYNAMIC JEWISH LAW; Progressive Halakhah - Essence and Application (1991), RABBINIC -LAY RELATIONS IN JEWISH LAW (1993), CONVERSION TO JUDAISM IN JEWISH LAW (l994), DEATH AND EUTHANASIA INJEWISH LAW (1995) and THE FETUS AND FERTILITY IN JEWISH LAW (1995), ISRAEL AND THE DIASPORA IN JEWISH LAW (1997).
